Where this policy refers to “we”, “us” or “our”, this means Physical Sports Group B.V. It is the controller within the meaning of the General Data Protection Regulation (GDPR).
2. Which data do we process?
This policy applies to all personal data you share with us via our website and web shop, email and telephone, social media, SMS and post. If you are under 16, a parent or legal guardian must place the order for you.
We process:
- first and last name;
- address;
- email address;
- telephone number;
- order and billing details;
- delivery address (also when it concerns a third party);
- payment details (via secure payment providers);
- account details (wish list, viewed products, abandoned carts);
- communication with customer service;
- reviews and feedback;
- marketing preferences;
- technical data (cookies, IP address, browser data).
We may also receive data from third parties, such as Meta (Facebook, Instagram), Google, TikTok, CRM systems and marketing and advertising platforms.
3. Purposes
a) Performance of the contract
Processing and delivering orders, customer service and returns, invoicing and payments, order and delivery updates.
b) Legal obligations
Accounting and retention obligations, handling complaints, security and fraud prevention.
c) Marketing with your consent
Newsletters and offers, email and SMS marketing, abandoned cart reminders, review requests, loyalty and referral programmes. You can always unsubscribe via the unsubscribe link or at support@phfitness.nl.
d) Legitimate interest
Improving our website and service, analysing website use, optimising campaigns, security and fraud prevention.
Shopify
Our web shop is hosted by Shopify. Shopify processes personal data when you visit our shop and make purchases. We use Shopify Network Intelligence: Shopify uses data about your interactions with our shop, other shops and Shopify to provide and improve services. For this purpose, data is shared with Shopify and other service providers, which may be located in other countries. See the Shopify Consumer Privacy Policy.
4. Legal bases
We process data on the basis of your consent (Art. 6(1)(a) GDPR), the performance of a contract (b), a legal obligation (c) and our legitimate interest (f).
5. Marketing
We only send marketing with your consent or where the law permits. Every email and SMS contains an unsubscribe option. After you unsubscribe, we keep your email address on a suppression list so that you receive no further messages.
6. SMS marketing
If you sign up, we use your telephone number for order updates, abandoned cart reminders, offers and review requests. You can unsubscribe by replying STOP or via the unsubscribe link. Message and data rates may apply.
7. Cookies
We use functional (necessary for the website to work), analytical, preference and marketing cookies. We only place non-essential cookies with your consent via our cookie banner. You can change your choice there at any time and delete cookies in your browser settings.
8. Security
We take appropriate technical and organisational measures to protect your data against loss, misuse and unauthorised access.
9. Retention periods
We keep data no longer than necessary: account and order data for as long as legal retention obligations apply; marketing data until you unsubscribe or withdraw your consent; reviews until you ask us to delete them, unless a longer retention period is required by law.
10. Your rights
You have the right of access, rectification, erasure, restriction of processing, objection, data portability and withdrawal of consent with effect for the future. Send your request to support@phfitness.nl; we respond within one month. For processing by Shopify, use the Shopify Privacy Portal.
11. Complaints
Please contact us first. You can also lodge a complaint with a data protection authority, such as the Dutch Autoriteit Persoonsgegevens or the authority in your country of residence.
12. Changes
We may amend this privacy policy. The current version is always available on our website.
